Food Safety

There are two main bodies of regulatory authority over food handling in Montgomery, as throughout New Jersey. Both retail food establishments and temporary retail food establishments must obtain a license from the Montgomery Township Health Department prior to operation. There is a Retail Food Establishment license and a Temporary Retail Food Establishment license (found below by location).

Retail Food Establishment

“Retail food establishment” means an operation that stores, prepares, packages, serves, vends, or otherwise provides food for human consumption:

  1. Such as a restaurant; satellite or catered feeding location; catering operation if the operation provides food directly to a consumer or to a conveyance used to transport people; market; vending location; conveyance used to transport people; institution; or food bank;
  2. And, that relinquishes possession of food to a consumer directly, or indirectly through a delivery service such as home delivery of grocery orders or restaurant takeout orders, or delivery service that is provided by common carriers.

Temporary Retail Food Establishment

“Temporary retail food establishment” means a retail food establishment that operates for a period of no more than 14 consecutive days in conjunction with a single event or celebration.

Retail food establishments and Temporary retail food establishments must follow regulations set forth in N.J.A.C 8:24 “Sanitation in Retail Food Establishments and Food and Beverage Vending Machines” and in Montgomery Township Board of Health Code Chapter BH:II Retail Food Establishments.
